Bank Robbery Defense in Newport News

Former-Prosecutor Insight for High-Stakes Bank Robbery Allegations

Bank robbery allegations can trigger a federal investigation, substantial prison exposure, and proceedings in federal court. Ehrenworth Law, PLLC represents people accused of bank robbery in Newport News, providing clear guidance from the investigation through the resolution of the charge.

We have handled criminal defense matters since 1998. Attorney Scott Ehrenworth served as a prosecutor in the Newport News and Portsmouth Commonwealth’s Attorney’s Offices for nearly a decade. That experience provides direct insight into how prosecutors assess evidence, construct charges, and prepare criminal cases.

Defense During an Investigation or After an Arrest

Our criminal defense practice includes federal crimes, violent crimes, and theft crimes. A bank robbery case may involve overlapping allegations concerning stolen property, intimidation, force, violence, or the use of a dangerous weapon or device.

We provide personalized counsel based on the circumstances of the accusation. The appropriate strategy depends on the alleged conduct, the evidence collected, the government agency involved, and whether prosecutors pursue charges under federal or Virginia law.

For someone under investigation but not yet charged, we address the case at its current stage rather than waiting for an indictment or arrest. After charges are filed, we focus on the statutory elements the prosecution must establish and the evidence it intends to use. At each stage, we develop a strategy around the client’s needs and goals.

Federal Bank Robbery Charges Under 18 U.S.C. § 2113

18 U.S.C. § 2113 governs prohibited conduct involving federally protected financial institutions, including covered banks, credit unions, and savings and loan associations. The applicable subsection depends on the allegations. An accusation involving intimidation differs legally from an alleged taking involving a weapon, assault, forced accompaniment, or death.

Federal bank robbery charges may involve these statutory provisions:

  • Taking by force, violence, or intimidation: Subsection (a) covers taking or attempting to take covered property through force and violence, intimidation, or extortion. It authorizes up to 20 years in prison plus a fine. The same maximum applies to certain entries or attempted entries made with criminal intent.
  • Taking property with intent to steal: Subsection (b) covers taking and carrying away covered property with the intent to steal. When the property is valued above $1,000, the maximum is 10 years of imprisonment plus a fine. When the value is $1,000 or less, the maximum is one year of imprisonment plus a fine.
  • Assault or use of a dangerous weapon: Subsection (d) applies when a person is assaulted or placed in jeopardy through a dangerous weapon or device during an offense covered by subsection (a) or (b). The statute authorizes up to 25 years of imprisonment plus a fine.
  • Forced accompaniment or death: Subsection (e) applies to killing a person or forcing someone to accompany another person without consent while committing an offense or avoiding apprehension. It carries a minimum prison term of 10 years. If death results, the statute permits life imprisonment or death.

These statutory ranges aren’t predictions about a particular case. Potential exposure depends on the subsection charged, the facts the government can prove, the defendant’s criminal history, and federal sentencing rules.

Virginia Law Governing Bank Robbery Allegations

Virginia Code § 18.2-93 addresses entering a banking house while armed with a deadly weapon and intending to commit larceny of money, bonds, notes, or other evidence of debt. A violation is a Class 2 felony punishable by 20 years to life in prison.

Virginia also classifies robbery offenses as felonies. Federal and Virginia statutes remain distinct, and the charging pathway depends on the institution involved, the alleged conduct, and the jurisdictional basis asserted by prosecutors. We examine the actual charge rather than assuming every accusation involving a financial institution will proceed under the same law.

Federal Investigations & Court Proceedings in Newport News

Federal crimes are typically investigated by agencies such as the FBI and prosecuted by the U.S. Department of Justice. An investigation may begin before the person under scrutiny receives formal notice of a charge. Contact from agents, a search, or a request for an interview shouldn’t be treated as routine.

Federal bank robbery cases arising in Newport News fall within the U.S. District Court for the Eastern District of Virginia, Newport News Division. These proceedings follow different rules and practices from Virginia criminal cases. Identifying the investigating agency and the statute under consideration is essential to evaluating the allegation and selecting a defense strategy.
